Abstract Article 1 of the Law of Ukraine “On Prevention of Corruption” No. 1700-VII of October 14, 2014 defines the term “specially authorized actors in the sphere of fighting against corruption” – the Prosecutor’s Office, the National Police, the National Anti-Corruption Bureau of Ukraine, the National Agency for the Prevention of Corruption. However, in some cases, law enforcement agencies, abusing this status, on their own initiative and in the absence of powers determined by law, attempt to collect information about possible violations of antitrust laws, which results in unjustified restrictions on human rights and freedoms.
Purpose of the article defined knowledge of the content and origin of the term “specifically authorized actors in the sphere of fighting against corruption”.
Part 5 of Art. 5 of the Law of Ukraine dated April 7, 2011, No. 3206-VI “On the Principles of Prevention and Counteraction of Corruption”, which was fully extinguished on September 1, 2016, was devoted to specifically authorized actors in the field of combating corruption, which meant entities, which directly implement within their competence measures for the detection, termination and investigation of corruption offenses. Instead, the current Law of Ukraine “On Prevention of Corruption” does not contain such a requirement. Instead of identifying their main features, only a comprehensive list of these subjects is given.
Each of the specially authorized entities carries out anticorruption activities within the limits of the powers granted to him. In particular, only the National Anti-Corruption Bureau of Ukraine and the National Police can conduct a pre-trial investigation of criminal offenses, while drafting protocols on corruption offenses committed by officials of the National Police and the National Agency for the Prevention of Corruption.
Consequently, the concept of “specially authorized actors in the sphere of fighting against corruption” is defined in the Law of Ukraine “On Prevention of Corruption”, in order not to duplicate the list of these bodies in the relevant articles of the Law at any time, while clarifying who belongs to them.
As a conclusion, it was stated that the membership of a particular body to specially authorized entities does not give its officials additional or special powers to detect, terminate or investigate corruption offenses. Legislative definition of “specially authorized actors in the sphere of fighting against corruption” serves as a benchmark for the list of bodies to be reported in cases of detection of corruption or corruption related offenses. The use of this legislative design has the advantages, as it contributes to the clarity of the presentation of the relevant legislative provisions, as well as individual deficiencies, as it requires the specification in sub-legal regulations, taking into account the competence of one or another specially authorized entity.
